Hereinafter referred to as “Sparkid” or “the Seller”.

Any order placed on the Website constitutes full and unconditional acceptance of these T&Cs.

Article 1 — Definitions

Customer: any natural or legal person making a purchase on the Website.

User: any person accessing the Website.

Product: any book, personalised product, accessory, option or service offered for sale on the Website.

Personalised book: a book created at the Customer’s request, incorporating, in particular, the child’s first name, photo, gender, age, a dedication or any other personalised element.

Order: the act whereby the Customer selects one or more Products, provides the information required for personalisation and makes payment.

Website: the website operated under the Sparkid brand.

Article 2 — Purpose

These T&Cs define the rights and obligations of the parties in relation to the online sale of Products offered by Sparkid.

Sparkid offers, in particular, personalised children’s books, created using information provided by the Customer and printed on demand.

Article 3 — Acceptance of the T&Cs

The Customer declares that they:

  • are at least 18 years old or have legal capacity;

  • have read these T&Cs before confirming their order;

  • accept these T&Cs without reservation.

Sparkid reserves the right to amend the T&Cs at any time.

The applicable version is the one in force on the date of the order.

Article 4 — Personalised Products

The Products offered on the Website are described and presented as accurately as possible.

Sparkid books are personalised using information provided by the Customer, including the child’s photo, first name, age, gender, any dedication and the chosen finish.

The Customer is responsible for the accuracy of the information submitted when placing the order.

Sparkid cannot be held liable for errors in information provided by the Customer, including:

  • a misspelt first name;

  • an error in the dedication;

  • the wrong photo being submitted;

  • a photo of insufficient quality;

  • an incorrect address;

  • an incorrect choice of finish or option.

The photographs, previews, mock-ups and visuals displayed on the Website are intended to illustrate the appearance of the Product. There may be slight variations in colour, framing, contrast, printing or presentation between the digital preview and the printed Product.

Article 5 — Personalised preview

Sparkid may offer the Customer a personalised preview before they place an order.

This preview shows the general style of the finished result, how the child’s face is incorporated and certain pages of the book.

The preview does not necessarily show the whole of the final book.

For technical and production reasons, and to ensure efficient logistics, the complete book may not be generated or approved page by page before printing.

The Customer acknowledges that the final result may differ slightly from the digital preview, in particular due to the printing, paper, chosen finish, generation algorithm used or screen display.

Article 6 — Prices

Prices are stated in euros (€) and include applicable VAT, unless otherwise indicated.

Sparkid reserves the right to change its prices at any time.

The applicable price is the one displayed when the order is confirmed.

Delivery charges, finish options, express delivery, gift wrapping and additional services are specified before the order is confirmed.

Article 7 — Orders

The ordering process may include, in particular:

  • choosing the book;

  • adding the child’s photo;

  • entering personalisation details;

  • viewing a preview, if available;

  • choosing the finish;

  • selecting any options;

  • confirming the basket;

  • entering contact details;

  • choosing the delivery method;

  • making payment;

  • confirmation by email.

The order is final once payment has been validated.

Sparkid reserves the right to:

  • refuse an order if fraud is suspected;

  • limit the quantities ordered;

  • cancel an order in the event of an obvious pricing error;

  • refuse an order whose content is manifestly inappropriate, unlawful, offensive or infringes third-party rights.

Article 8 — Payment

Payment is due immediately when the order is placed.

Payments are processed securely through external providers.

Sparkid does not store any banking details.

If payment is declined, the order will not be confirmed.

Article 9 — Production and printing

Sparkid books are printed on demand after the order has been confirmed.

Production time depends on the Product, the chosen finish, the printing supplier and when the order is placed.

Once the order has been sent for production, it may no longer be possible to amend or cancel it.

Sparkid reserves the right to place an order temporarily on hold in the event of a technical issue, a file that does not meet requirements, an unusable photo or doubts about the information provided.

Article 10 — Delivery

Products are dispatched to the address provided by the Customer when placing the order.

The Customer is responsible for ensuring that the delivery address is accurate and complete.

The delivery times indicated on the Website are estimates and generally include production and transit time for the Product.

Depending on the country, delivery method and chosen finish, several options may be offered:

  • standard delivery;

  • tracked delivery;

  • fast delivery;

  • express delivery.

Sparkid cannot be held liable for delays attributable to:

  • the carrier;

  • an incorrect or incomplete address provided by the Customer;

  • the recipient’s absence;

  • an event of force majeure;

  • customs checks;

  • busy periods, including Christmas, Saint Nicholas Day, Black Friday or seasonal celebrations.

Risk passes to the Customer when the parcel is received by the Customer or by any person they have designated.

Article 11 — International delivery, customs and taxes

Sparkid may offer delivery to several countries.

For deliveries outside the European Union, customs duties, import taxes, administrative fees or additional delays may apply.

Any such charges are payable by the Customer and depend on the regulations of the country of delivery.

Sparkid cannot guarantee that no additional charges will be imposed by the customs or tax authorities of the destination country.

Article 12 — Right of withdrawal

Under the law applicable to distance sales, consumers are, in principle, entitled to a withdrawal period of 14 days.

However, this right of withdrawal does not apply to goods made to the consumer’s specifications or clearly personalised. As Sparkid books are created on demand with personalised elements, including the child’s first name, photo, dedication and character, the right of withdrawal generally cannot be exercised after an order has been placed. This exception is provided for by European rules on personalised goods.

Consequently, except in the event of a defect, an error attributable to Sparkid or an exceptional commercial agreement, personalised books cannot be returned or refunded after the order has been confirmed.

If a non-personalised Product is offered on the Website, a Customer who is a consumer may exercise their right of withdrawal within the statutory period of 14 days, provided that the Product is returned unused, complete, in its original condition and with proof of purchase.

Return costs are payable by the Customer, except in the event of an error by Sparkid or a defective Product.

Article 13 — Changes after ordering

The Customer must carefully check all information before confirming the order.

If an error is identified after ordering, the Customer must contact Sparkid as soon as possible using our contact form.

If the order has not yet been sent for production, Sparkid will use its best efforts to make the requested change.

If the order is already in production or has been printed, no changes can be guaranteed.

Article 13 — Damaged Products, defects or errors

If the Customer receives a Product that is damaged, defective or does not match the order, they must contact Sparkid within a reasonable time, ideally within 7 days of receipt.

The request must include:

  • the order number;

  • the email address used when placing the order;

  • a description of the problem;

  • photos of the Product and/or parcel, if necessary.

Following a review, Sparkid may offer, depending on the circumstances:

  • a reprint;

  • a replacement shipment;

  • a partial refund;

  • a full refund;

  • any other appropriate solution.

Sparkid may refuse a request if the defect results from misuse, damage caused by the Customer or an error in information provided by the Customer when placing the order.

Article 15 — Statutory guarantees

Under Belgian law, a Customer who is a consumer benefits from the two-year statutory guarantee of conformity for tangible goods, as well as the guarantee against hidden defects where the conditions are met.

The statutory guarantee covers any lack of conformity existing at the time of delivery.

It does not cover, in particular:

  • normal wear and tear;

  • misuse;

  • damage caused by the Customer;

  • accidental damage;

  • a personalisation error resulting from information provided by the Customer;

  • subjective dissatisfaction relating to an approved preview or a personal preference, unless there is an actual defect in the Product.

Article 16 — Liability

Sparkid cannot be held liable for:

  • indirect damage;

  • operating losses;

  • temporary interruptions to the Website;

  • technical errors beyond its control;

  • errors or delays attributable to external providers;

  • consequences arising from misuse of the Product;

  • errors in information provided by the Customer during personalisation.

In all cases, Sparkid’s liability is limited to the value of the order concerned, unless otherwise provided by law.

Article 17 — Intellectual property

Any reproduction, distribution, modification or use without prior written permission is prohibited.

The books, illustrations, stories, characters, layouts and content created by Sparkid remain protected by intellectual property law.

The purchase of a Product does not grant the Customer any right to reproduce, commercially exploit or modify Sparkid content.

Article 18 — Photos and content provided by the Customer

The Customer warrants that they hold the necessary rights to submit the photos, first names, texts, dedications or content used for personalisation.

The Customer undertakes not to submit content that:

  • is unlawful;

  • is offensive;

  • is discriminatory;

  • infringes a third party’s rights;

  • infringes another person’s privacy;

  • does not relate to a child for whom they have the necessary authorisation.

Sparkid reserves the right to refuse or cancel an order if the content submitted is manifestly inappropriate or unlawful.

Article 19 — Personal data

The photos and information submitted are used to create the preview, produce the personalised book, process the order, provide customer support and comply with applicable legal obligations.

If the Customer submits a photo, video or testimonial, they authorise Sparkid to use it on its Website, social media, marketing or advertising materials.

The Customer may contact Sparkid at any time to request that we stop using the image or photo provided.

Article 22 — Force majeure

Sparkid cannot be held liable for failure or delay in performing its obligations in the event of force majeure within the meaning of Belgian law.

Events of force majeure include, but are not limited to: strikes, natural disasters, fires, a pandemic, war, a cyberattack, a major breakdown, interruption of transport services, failure of an essential service provider or an administrative decision.

Article 23 — Severability

If any clause of these T&Cs is declared void, unlawful or unenforceable, the remaining provisions shall remain fully enforceable.

Article 24 — Governing law and disputes

These T&Cs are governed by Belgian law.

In the event of a dispute, an amicable resolution will be favoured.
